Intermediary Status Under Section 79 (IT Act)

BizLiveGo (operated by MD Joshim Biswas) functions as an electronic intermediary under Section 2(1)(w) of the Information Technology Act, 2000 of India.

Pursuant to Section 79 of the IT Act, BizLiveGo does not initiate data transmissions, select receivers of information, or modify information contained in user-hosted profiles, business listings, or portfolios. Our role is strictly limited to providing automated technological infrastructure, hosting servers, dynamic QR routing, and front-end scaling code.

No Professional or Legal Advice

All platform materials, compliance documentation, template code structures, and instructional guides are made available for general informational and technological enablement purposes only.

• Nothing published on our website constitutes formal legal, financial, taxation, or medical advice.
• Subscribers should consult certified legal counsel or tax accountants for jurisdictional legal determinations.

1. No Independent Verification

BizLiveGo does not pre-screen, audit, authenticate, or verify claims, qualifications, pricing, trade licenses, or business credentials displayed on individual user profile pages.

All statements, menu offerings, job credentials, and pricing displayed on subdomains are the sole responsibility of the respective account publisher.

2. Non-Endorsement Standard

The appearance of any merchant, professional contractor, doctor, lawyer, matrimonial biodata, or trade supplier on our platform does not constitute an endorsement, sponsorship, or recommendation by BizLiveGo.

Clients interact, negotiate, and transact with profile owners entirely at their own independent risk.

3. Zero Commercial Liability

BizLiveGo is not a party to any commercial contracts, payments, engagements, or consumer disputes between profile publishers and their visiting clients.

We bear zero liability for default, misrepresentation, fraud, or service defects originating from third-party profile operators.

1. Dynamic QR Redirection

Because BizLiveGo dynamic QR codes allow subscribers to change destination URLs in real time from their dashboards, BizLiveGo cannot guarantee the ongoing safety, content, or legality of destinations redirected by profile owners after physical print distribution.

Users scan external QR links subject to standard web browsing precautions.

2. Mapping & Geolocation Discrepancies

Interactive map widgets and location coordinate pickers rely on third-party APIs (such as Google Maps and OpenStreetMap). BizLiveGo does not warrant the geographic precision, road route accuracy, or navigation safety of coordinates configured by subscribers.

Users should confirm precise storefront locations prior to physical transit.

3. External Outbound Hyperlinks

Profiles and templates hosted on BizLiveGo routinely contain links to external social media platforms (WhatsApp, Facebook, LinkedIn, Instagram, payment portals). BizLiveGo exercises no editorial control over the privacy policies, terms, or security practices of external web properties.

Visiting external sites occurs strictly under the third party's separate terms.

"As-Is" & "As-Available" Provision

BizLiveGo provides all digital profile hosting platforms, dynamic QR routing engines, code templates, and software features on an "AS-IS" and "AS-AVAILABLE" basis without express or implied warranties of any kind.

• We disclaim all implied warranties of merchantability, fitness for a particular commercial purpose, title, and non-infringement.
• We do not warrant that platform operations will be completely uninterrupted, timely, bug-free, or entirely secure from sophisticated zero-day cyber threats.
• Subscribers maintain sole responsibility for preserving local backups of uploaded media files and descriptive text.

Uptime, CDN Latency & Downtime Limits

While our architecture targets 99.0% server availability across Cloudflare's international edge network:

• Temporary latency or transient downtime may occur during essential off-peak maintenance, core updates, or upstream ISP submarine fiber cuts.
• BizLiveGo is not liable for indirect commercial losses, lost leads, missed inquiries, or advertising expenditures resulting from unexpected downtime.
• Service outages qualifying for billing credits are managed under our standard 7 to 15 working days SLA pursuant to our published Refund Policy.

1. Exclusion of Consequential Damages

In no event shall BizLiveGo, its founder MD Joshim Biswas, employees, or technical contractors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages whatsoever.

Includes lost profits, lost business opportunities, reputational harm, data loss, or system interruption.

2. Absolute Monetary Liability Cap

BizLiveGo's total aggregate liability arising out of or related to your use of the platform, subscriptions, dynamic QR codes, or template code shall in no event exceed the total monetary amount actually paid by you to BizLiveGo in the preceding three (3) calendar months, or ₹2,500 INR, whichever is lower.

This cap applies regardless of whether legal claims sound in contract, tort, or negligence.

3. Statutory Consumer Protections

Nothing in this Legal Disclaimer is intended to limit or exclude statutory consumer rights that cannot be lawfully waived or excluded under the Consumer Protection Act, 2019 of India or prevailing consumer jurisdictions.

Where exclusions are held unenforceable, liability is restricted to the maximum extent permitted by law.
