1. Contractual Scope

Operating Merchant & Binding Applicability

These Master Terms constitute an enforceable commercial contract between BizLiveGo (operated by sole proprietor MD Joshim Biswas) and any individual, enterprise, developer, or creator accessing our services.

Our operations strictly comply with the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Indian Contract Act, 1872, and the Arbitration and Conciliation Act, 1996.

2. Acceptance Standards

Electronic Signature & Clickwrap Assent

By registering an account, purchasing layout templates, provisioning dynamic QR codes, deploying API endpoints, or enrolling in partner tiers, you express irrevocable assent to these terms.

  • Assent constitutes an electronic contract under Section 10A of the IT Act.
  • Continued use following terms updates constitutes ongoing ratification.
  • Material terms revisions are communicated with at least 30 days' advance notice.
3. Platform Core Terms

Terms of Service, User Agreement & Marketplace Rules

Foundational standards governing platform accounts, user representations, and catalog transactions:

BizLiveGo provides web-based business profile publication tools, responsive zero-cut viewports, dynamic QR redirection routing, and downloadable bio generators on a prepaid SaaS subscription model.

Accounts must be operated by persons at least 18 years of age possessing legal capacity to contract.

135. User Agreement

Subscribers retain ownership of trademarks and media uploaded to profiles while granting BizLiveGo a worldwide, royalty-free license to host, cache, and distribute assets across edge CDN nodes.

Users are solely responsible for keeping login credentials confidential and maintaining local data backups.

136. Marketplace Terms

Where the platform facilitates sales between independent merchants and visiting consumers, BizLiveGo functions strictly as an electronic intermediary under Section 79 of the IT Act.

Merchant order fulfillments, deliveries, product warranties, and return agreements rest entirely between merchants and their buyers.

4. Absolute Exclusion of Sensitive Identity Credentials & Financial Secrets

Pursuant to statutory intermediary obligations and PCI-DSS Level 1 governance, BizLiveGo enforces an architectural ban against hosting or processing raw national identity credentials:

Strictly Prohibited Identifiers

Users, developers, creators, and partners must never submit:

  • National identity documents, government citizen numbers, or unredacted ID card images.
  • Payment card CVVs, magnetic stripe tracks, ATM PINs, net banking passphrases, or OTP secrets.
  • Unredacted biometric templates, private health records, or confidential corporate secrets.

Enforcement & Safe Harbor Takedowns

Intermediary security and safe harbor protections:

  • Inadvertently submitted forbidden credentials undergo immediate automated cryptographic shredding.
  • Profiles distributing financial phishing lures or malicious payloads are suspended within 24 to 36 hours.
  • Reversals and refunds route solely via tokenized PCI-DSS Level 1 payment gateway rails (7–15 days SLA).
5. Commercial Ecosystem

Creator Marketplace, Affiliate Programs, Partner Standards & API Terms

6. Community Standards

141. Acceptable Use Policy (AUP) & Platform Protection

Mandatory conduct standards enforceable across all subscriber profiles, subdomains, and dynamic QR endpoints:

Prohibited Platform Conduct

Subscribers and visitors must never utilize platform services to:

  • Publish malware, ransomware, spyware, trojan payloads, or drive-by exploit scripts.
  • Create phishing lures mimicking banking institutions, government portals, or utility boards.
  • Broadcast unsolicited bulk commercial messages (SMS/WhatsApp spam or mailer lists).
  • Host child sexual abuse material (CSAM), non-consensual imagery, or violent extremism.
  • Decompile, reverse engineer, or scrape proprietary viewport scaling and sync code engines.

Remedies & Account Sanctions

In the event of an identified breach of our Acceptable Use Policy:

  • Immediate Containment: Profile URLs and dynamic QR codes are severed instantly (HTTP 403/Forbidden).
  • Zero Refund Forfeiture: Accounts terminated for malicious abuse forfeit remaining subscription balances.
  • Permanent Blacklist: Associated IP subnets, domains, and payment tokens are added to risk registries.
  • Law Enforcement Escalation: Severe cyber offences are reported to relevant statutory cyber crime desks.
7. Legal Recourse

Governing Law, Informal Dispute Resolution & Sole Arbitration

How legal disputes, contractual claims, and jurisdictional proceedings are arbitrated:

142. Governing Law

These Master Terms, privacy disclosures, and commercial agreements shall be governed by, interpreted, and construed exclusively in accordance with the substantive laws of the Republic of India, without regard to conflict of laws principles.

143. Dispute Resolution (30-Day)

Before initiating formal arbitration, parties agree to engage in good-faith informal negotiation for a period of thirty (30) calendar days from receipt of written dispute notice sent to our legal desk at support@bizlivego.com.

144. Arbitration & Jurisdiction

Unresolved disputes shall be referred to binding arbitration seated in Malda, West Bengal, India, under the Arbitration and Conciliation Act, 1996, conducted in English by a sole arbitrator appointed by mutual consent.

Exclusive Judicial Forum

Subject to the binding arbitration covenant above, the civil courts having competent territorial jurisdiction in Malda and the High Court at Calcutta, West Bengal, India, shall possess sole and exclusive jurisdiction over any auxiliary legal proceedings, injunctions, or enforcement decrees arising under these Terms.

  • Emergency Turnaround: Inquiries involving imminent threats to human life or bodily safety are reviewed within 6 to 12 hours.
  • Standard Response Window: Routine civil discovery or statutory production inquiries are fulfilled within 24 to 72 hours.
